Town Planning
Currently Emerald Shire Council approves all development in
accordance with its Strategic Plan and Town Planning Scheme. This Planning
Scheme controls the types of land uses that can occur within the Shire. This
scheme was gazetted on the 17.08.95 with two amendments gazetted on the 18.12.98
and the 16.2.00. Controls are set in place by way of Tables of Zones, which
define the type of use permitted with or without approval. The scheme also
states the level of assessment, which will be required. Currently these are
self-assessable and assessable.
The Planning Scheme also contains development manuals,
which provide the Council and applicants with a guide to the various
requirements for development. These development manuals include
applications, residential development (Class 1 and 10 structures) multiple
dwellings, rural development, commercial and industrial development
engineering works and open space. These manuals should be consulted for all
self-assessable development. The onus for checking development complies with
the manuals for self-assessable development is with the applicant. However,
Council does provide a compliance check service with a fee of $25 payable.
All of these documents are available for purchase,
individually or separately at the Planning Department. The development
manuals are free.
Zoning maps are available at the Planning Department
for perusal.
Town Planning Department is to be given five (5)
business days prior written notice for the issuing of Limited Town Planning
Certificates.

Timing of Development Approval
As a guide, any Code assessment application (no advertising required), will
take 4-6 weeks to be processed through Council. Impact assessment
applications can take 2-3 months depending upon the issues and other Council
commitments.

Submissions on Proposals
Any person may submit a written submission to Council for any proposed
development provided the submission is on planning grounds. These grounds

Planning Scheme Review
Currently, the Emerald Shire Council's Planning Scheme is under review. At
least one opportunity for public input will be provided during this process.
Prelodgement Assistance with Proposals
Prior to the lodgement of applications, Council prefers discussions to take
place. The Shire Planner will be happy to provide this assistance. It is
advisable to make an appointment for detailed proposals. These discussions
can determine the level of assessment and identify the issues to be
addressed as well as the process to be followed.

State Agencies for proposals, which include matters of state interest. For
